CBP's New System for IEEPA Tariff Refunds

The U.S. Customs and Border Protection (CBP) has announced a new administrative solution to refund the substantial tariffs collected under the International Emergency Economic Powers Act (IEEPA). This response follows a recent ruling by the Court of International Trade (CIT).

Due to the massive volume of affected imports, individually processing each entry is impractical. Therefore, CBP plans to implement a streamlined process using its Automated Commercial Environment (ACE) system to aggregate refunds by importer.

Challenges and Solutions

CBP has identified six technical challenges in processing IEEPA tariff refunds:

• IEEPA tariffs are not listed as separate items in most import records, making them difficult to identify.
• The system's batch processing capability is limited and prone to errors.
• Interest calculations often require manual intervention.
• Each refund requires a dual authentication process.
• Most importers have not enabled electronic refund receipt functionality.
• Diverting personnel to handle refunds would significantly impact CBP's other operations.

To address these issues, CBP is developing a new ACE feature. This process involves importers submitting a comprehensive list of all goods subject to IEEPA tariffs through the ACE system. The system will automatically verify the list and recalculate the taxes and interest due, excluding IEEPA tariffs. Once verified by CBP, refunds will be initiated.

Implementation Timeline and Registration

CBP aims to complete the development and deployment of this new feature within 45 days. However, the actual time required to process refunds after the system goes live remains uncertain.

Since February 6, CBP has only issued refunds electronically. Yet, only 21,200 out of over 330,000 importers have completed the electronic refund system registration, a very low percentage. CBP warns that any importer who has not completed this setup will have their refund application denied until registration is complete.

Legal Considerations

According to legal requirements, the U.S. government has 60 days from the issuance of an order to submit an appeal notice. Therefore, the success of CBP's large-scale refund plan depends not only on the CIT's approval but also on whether the government decides to appeal.
